These Terms of Service ("Terms") govern your access to and use of the PND AI Photo Enhancer HD mobile application (the "App") provided by PND AI ("we", "our", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
PND AI Photo Enhancer HD is a mobile application that uses artificial intelligence to enhance the quality of digital photos. Photos you choose to enhance are uploaded over HTTPS to our own servers, processed by our self-hosted AI model, and the enhanced result is returned to your device. Uploaded photos and processed results are automatically deleted from our servers within 24 hours. For full details on data handling, see our Privacy Policy.
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and the age of majority in your jurisdiction, you may use the App only with the consent of a parent or legal guardian.
User account: You may optionally sign in with your Google account to sync your VIP plan and credits across devices and with our website. You can delete your account at any time in the app (Account > Delete account) or at pndai.ai/delete-account.php.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use.

You retain all rights, title, and interest in the photos you upload to the App. We do NOT claim any ownership over your photos.
By uploading a photo, you grant us a limited, temporary license to receive, process, and return the enhanced result to you. This license is strictly limited to the purpose of providing the enhancement service and terminates automatically when the photo is deleted from our servers (within 24 hours).

We reserve the right to refuse processing of, or terminate access for, any user who violates these requirements. We may report illegal content to law enforcement as required by law.
The App offers a free tier with limited functionality, supported by advertisements served via Google AdMob. By using the free tier, you acknowledge and agree that ads will be displayed within the App.
The App offers both one-time in-app purchases (e.g., credit packs, individual features) and auto-renewing subscriptions for premium features. All purchases are processed through Apple App Store (iOS) or Google Play (Android) and are subject to their respective payment terms.

Subscription and in-app purchase prices are displayed within the App at the time of purchase. Prices may vary by region and currency. Apple App Store and Google Play may apply local taxes.
All refund requests must be submitted directly to Apple App Store (for iOS purchases) or Google Play (for Android purchases). We do not process refunds directly. Refund eligibility is determined by Apple and Google according to their respective policies.
We strive to keep the App available 24/7 but do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, server issues, or events beyond our control. We may modify, suspend, or discontinue any feature or the entire App at any time, with or without notice.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PND AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP.
Our total liability for any claim arising out of these Terms shall not exceed the amount you have paid us (if any) in the twelve (12) months preceding the claim, or USD 100, whichever is greater.
You agree to indemnify, defend, and hold harmless PND AI and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App, (b) your violation of these Terms, (c) your violation of any third-party right, including intellectual property or privacy rights, or (d) the content of photos you upload.
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms. Upon termination, your license to use the App ends immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) shall survive.
We may update these Terms from time to time. Material changes will be reflected in an updated "Last updated" date at the top of this page. Continued use of the App after such changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the competent court of Vietnam having jurisdiction.
Nothing in these Terms shall affect any non-waivable statutory rights you have as a consumer under applicable law in your country of residence.
You acknowledge that these Terms are between you and PND AI only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
You acknowledge that these Terms are between you and PND AI only, not with Google LLC ("Google"). Google is not responsible for the App or its content. Your use of the App must comply with the Google Play Terms of Service.
